1) Overview and Overlap with SailGP Accreditation Terms & Conditions
1.1. These terms and conditions (“Media and Filming T&Cs”) are issued by F50 League LLC (“SailGP”) and govern the issuance of media accreditation (“Media Accreditation”) and filming accreditation (“Filming Accreditation”), as well as passes to individuals working in the media space or otherwise permitted to film (who validly satisfy an eligibility requirement of paragraph 2.2.1. or 2.3.1. below – each an “Applicant”) for one or more sailing events forming part of the Rolex SailGP Championship or training sessions for such events (collectively, “Events”) staged by SailGP.
1.2. These Media and Filming T&Cs are supplementary to the SailGP Accreditation Terms and Conditions.
1.3. Capitalised terms used but not defined have the meaning given to them in the SailGP Accreditation Terms and Conditions.
1.4. Each Applicant for Media Accreditation or Filming Accreditation is personally bound by these Media and Filming T&Cs as well as the terms of the SailGP Accreditation Terms and Conditions. Each Media Accreditation and Filming Accreditation is individual and personal to the Applicant granted it, and grants no right for any other person to receive accreditation. Any person who wishes to accompany a successful Applicant must apply for their own Media Accreditation or Filming Accreditation, and will be considered a separate Applicant for the purposes of these Media and Filming T&Cs.
1.5. In the case of a conflict between these Media and Filming T&Cs and the SailGP Accreditation Terms and Conditions, the terms of these Media and Filming T&Cs shall prevail.
1.6. SailGP may update these Media and Filming T&Cs as it deems necessary in its sole discretion, with each update taking effect from the date of issue. Each Applicant must ensure they check these Media and Filming T&Cs as linked in SailGP’s Media Hub for updates before attending each Event. SailGP need not notify Applicants of any changes to these Media and Filming T&Cs.
2) Application Process and Eligible Categories of Media Accreditation and Filming Accreditation
2.1. Initiating applications
2.1.1. Media Accreditation must be applied for via the SailGP Media Hub. Filming Accreditation must be applied for: (i) in the case of Applicants who consider they are eligible under paragraphs 2.3.1(a), 2.3.1(b) or 2.3.1(c), via the SailGP Productions team; and (ii) in the case of Applicants who consider they are eligible under paragraph 2.3.1(d), via the SailGP Partnerships team.
2.2. Media Accreditation Eligibility
2.2.1. Media Accreditation is reserved for individuals who are approved members of the media or presenters for SailGP contracted rightsholders, and to be eligible for Media Accreditation as an Applicant, an individual must belong to one of these categories:
a) News organisations: Individuals whose primary role is reporting, writing, photographing, and/or editing news or editorial content for a recognized news-gathering organization. Freelancers may also be granted media accreditation pursuant to this category, however they will be required to provide proof of assignment from the editorial organization in advance when submitting their application.
b) Rightsholder media entity (presenters only): Media organisations that hold a media rights agreement with SailGP pursuant to which they have been granted rights to live, delayed or on-demand coverage at the Events. Access and content use are governed by the specific contractual agreement between the organisation and SailGP and all rights-holders and their staff, contractors, and any sub-contractors must comply with the terms of their agreement with SailGP. Applicants granted Media Accreditation under this paragraph 2.2.1(b) will have access to the media centre at the applicable Event (subject to the rest of these Media and Filming T&Cs) but no access to the tech site, except with the express permission of SailGP otherwise. Any Applicants from rightsholder media entities, whether presenters or not, may be eligible for Filming Accreditation, the determination as to which type of accreditation is most appropriate in each case being made by SailGP in its sole discretion.
c) Social media: please note that while non-traditional/editorial media can apply for Media Accreditation, each such application will be reviewed and eligibility determined by SailGP on a case-by-case basis and in line with sufficient capacities at the applicable Event.
2.3. Filming Accreditation Eligibility
2.3.1. An Applicant who does not satisfy any of the paragraph 2.2.1. conditions to receive Media Accreditation may instead be eligible for Filming Accreditation if they belong to one of the following categories:
a) Rightsholder broadcaster: as outlined in paragraph 2.2.1(b), above, any Applicants for rightsholders may be eligible for Filming Accreditation. Filming Accreditation granted under this paragraph 2.3.1(a) will by default include access to the race stadium and tech site at the applicable Event(s).
b) Non-rightsholding broadcaster: other third party broadcasters who have been granted a right and license by SailGP to attend an Event for the purpose of capturing and recording audiovisual content. Access and content use are governed by the specific contractual agreement between the organisation and SailGP and all non-rightsholders and their staff, contractors, and subcontractors must comply with the terms of their agreement with SailGP. Filming Accreditation granted under this paragraph 2.3.1(b) will by default include access to the race stadium and tech site at the applicable Event(s).
c) External production company: where the applicable production company has been approved by SailGP to produce broadcast/episodic content production for one or more Event(s) and therefore has a legitimate need for Filming Accreditation. All reviews of Applicants seeking Filming Accreditation under this paragraph 2.3.1(c) will consider the terms of the relevant contractual arrangements between the creative agency and SailGP. Filming Accreditation granted under this paragraph 2.3.1(c) will by default include access to the race stadium and tech site at the applicable Event(s).
d) Commercial partner filming: where the applicable agency has been contracted by SailGP, a SailGP partner/sponsor or SailGP Championship team partner/sponsor to perform content-related services relating to one or more Event(s), and therefore has a legitimate need for Filming Accreditation. All reviews of Applicants seeking Filming Accreditation under this paragraph 2.3.1(d) will consider the terms of the relevant contractual arrangements between the creative agency and SailGP. Filming Accreditation granted under this paragraph 2.3.1(d) will by default include access to the race stadium only. Creative agencies for SailGP Championship teams are only allowed to capture team content (at their team’s base), and all other content is to be supplied by SailGP (with SailGP reserving the right to charge a technical fee for such content).
4) Access granted by Media Accreditation and Filming Accreditation, Rights and Obligations
4.1. An Applicant granted Media Accreditation may be given access to certain media facilities, including the official media centre (where one is present at the applicable Event) during stated opening hours. The official media centre is not open to holders of Filming Accreditation save with the express permission of SailGP.
4.2. An Applicant granted Media Accreditation or Filming Accreditation will be granted access to certain areas at the Event for the sole purpose of: (i) in the case of Media Accreditation granted under paragraph 2.2.1(a), news reporting and journalism; or (ii) in the case of other Media Accreditation and all Filming Accreditation, capturing audiovisual content, in accordance with the rules for their applicable category under paragraph 2.2.1(b), 2.2.1(c) or paragraph 2.3.1(a)-(d), as well as any additional permissions or restrictions communicated by SailGP.
4.3. Only Applicants granted Filming Accreditation under paragraph 2.3.1(a) may broadcast the racing at Events live, in each case subject to the terms of the media rights agreement entered into between the relevant rightsholder and SailGP. For: (i) all other categories of Filming Accreditation, any use of SailGP-provided footage is subject to a contractual framework permitting this being in place with SailGP; and (ii) for all Media Accreditation , use of SailGP-provided footage is permitted strictly subject to these conditions: (i) only a maximum of 60 seconds of race footage per race day and 120 seconds per program may be used, for editorial purposes only; (ii) footage may only be used in the 24-hour period directly following the end of racing of each race day; and (iii) no archival rights are granted. SailGP alone shall own and retail all copyright and other intellectual property rights in any race footage distributed under these Media and Filming T&Cs, whether distributed by rightsholders or non-rightsholders.
4.4. Any content captured at Events by Applicants granted Media Accreditation or Filming Accreditation must be used for editorial purposes only, not for commercial purposes, save for Applicants engaged on behalf of SailGP partners/sponsors with Filming Accreditation granted under paragraph 2.3.1(d), who may use the content they capture at Events for commercial purposes strictly provided this complies with the written contractual arrangements the applicable partner/sponsor has in place with SailGP.
4.5. Any Applicant granted Media Accreditation or Filming Accreditation who is planning to use any equipment that uses radio frequency (i.e. still camera/flash trigger, wireless microphone, MIFI device, broadcasting equipment, handheld radio, drone) while covering an Event, must fill in this form (https://docs.google.com/forms/d/e/1FAIpQLSduXJOFrSo-uhtJZgZvJXZLOZRXRzBf0cNnuQjeHulb702u9g/viewform) and provide critical technical data so SailGP can prevent interference between broadcast feeds and venue emergency services.
4.6. Neither Media Accreditation nor Filming Accreditation includes access to VIP lounges, hospitality areas or restricted zones, including Race HQ, the Broadcast Compound and other operational or back-of-house areas, except where accompanied by a member of the SailGP media team, or otherwise as expressly permitted by SailGP.
4.7. Where an Applicant is granted access to the tech site at an Event under these Media and Filming T&Cs, they must not enter or film in private areas: (i) without express permission; and/or (ii) without relevant SailGP or team personnel present. This includes individual team bases and SailGP operational containers, including the Tech HQ, Oracle Performance Engineering, Hydraulic, and Sailmaking. Even where permission is granted and relevant personnel is/are present, the Applicant must not capture content featuring any private notes or anything else that might reasonably be considered to be confidential information.
4.8. Media Accreditation and Filming Accreditation will not ordinarily permit an Applicant to conduct filming on-water or access on-water areas (by boat charter or otherwise). SailGP may make exceptions on a case-by-case basis at its sole discretion; if SailGP does, the applicable Applicant must strictly comply with all instructions conveyed by SailGP as a condition of granting the relevant exception. If the Applicant is invited aboard a SailGP boat, they must comply with all instructions of SailGP staff on board.
5) Arrival, registration and operational rules for Media Accreditation and Filming Accreditation
5.1. Each Applicant granted Media Accreditation must register at the designated media centre (unless another registration location is otherwise advised) upon arrival. Arrival times and operations for Applicants granted Media Accreditation are determined by the SailGP media team; early entry without prior agreement is prohibited. Seating space at the media centre is subject to availability.
5.2. Each Applicant granted Filming Accreditation under paragraphs 2.3.1(a) to 2.3.1(c) must liaise with the SailGP Productions team a reasonable time prior to arrival at each applicable Event and follow any instructions regarding registration. Arrival times and operations will be determined by the SailGP Productions team and the SailGP Productions team shall oversee the Applicant while at the Event.
5.3. Each Applicant granted Filming Accreditation under paragraph 2.3.1(d) must liaise with the SailGP Partnerships team and any applicable SailGP Championship team (if filming for such a team) a reasonable time prior to arrival at each applicable Event and follow any instructions regarding registration. Arrival times and operations will be determined by the SailGP Partnerships team and the SailGP Productions team shall oversee the Applicant while at the Event.
5.4. Applicants granted Media Accreditation must wear media lanyards at all times. Media vests must be worn when requested by the SailGP staff. Applicants granted Filming Accreditation must wear identifiable clothing (generally either media vests or orange bibs) and any other reasonable visual identifiers as SailGP specifies on an Event-by-Event basis at all times (subject to any other instructions of SailGP).
5.5. While filming, accredited Applicants must pay attention to other spectators and guests in order to not obscure their views of racing, or make them feel uncomfortable (for example, focusing filming on individuals who clearly do not want to be filmed).
5.6. No drones are permitted at or around any Event sites except with the express prior written consent of SailGP.
5.7. SailGP may require any Applicant granted Media Accreditation or Filming Accreditation to delete any content they capture which SailGP considers to have been captured in breach of these Media and Filming T&Cs and/or the SailGP Accreditation Terms and Conditions.
6) Refusal and Revocation of Media Accreditation and Filming Accreditation
6.1. SailGP reserves the right to refuse Media Accreditation and Filming Accreditation to any Applicant who SailGP determines in its absolute discretion would not be an appropriate recipient of Media Accreditation and/or Filming Accreditation (as applicable). SailGP need not provide reasons for refusal to the Applicant. SailGP may alternatively determine that an Applicant for Media Accreditation is not suitable for Media Accreditation but is suitable for Filming Accreditation, or vice versa. Any such determination is final.
6.2. SailGP reserves the right to revoke Media Accreditation and/or Filming Accreditation granted to any Applicant, including during an Event when the Applicant is present onsite, in accordance with the requirements of paragraph 38 of the SailGP Accreditation Terms and Conditions. Additionally, SailGP may withdraw Media Accreditation and/or Filming Accreditation granted to any Applicant for any reason whatsoever, acting in its sole discretion.
